"Bayland Recruitment" or "the Company" refers to Bayland Recruitment Ltd, registered in New Zealand.
"Worker" refers to any individual who registers with Bayland Recruitment for the purpose of obtaining temporary, fixed term, or permanent employment.
"Client" refers to any business or organisation that engages Bayland Recruitment to supply workers.
"Assignment" refers to the period during which a Worker is supplied by Bayland Recruitment to work for a Client.
By registering with Bayland Recruitment, the Worker agrees to:
Workers engaged on temporary or fixed term assignments are employed by Bayland Recruitment for the duration of the assignment. Bayland Recruitment is responsible for the payment of wages, PAYE, ACC levies, and KiwiSaver contributions as required by New Zealand law.
Permanent placements are direct employment arrangements between the Worker and the Client. Bayland Recruitment's involvement ceases upon successful placement.
Workers will be paid the agreed rate for all hours worked. Timesheets must be submitted accurately and on time as directed. Payment is made in accordance with Bayland Recruitment's standard pay cycle.
Holiday pay and other statutory entitlements will be provided in accordance with the Holidays Act 2003 and other relevant New Zealand legislation.
Bayland Recruitment takes its responsibilities under the Health and Safety at Work Act 2015 seriously. Workers must:
Either the Worker or Bayland Recruitment may terminate the employment relationship by providing reasonable notice. Bayland Recruitment reserves the right to terminate an assignment or the employment relationship immediately in cases of serious misconduct, breach of these terms, or at the Client's request.
Clients engaging Bayland Recruitment agree to:
Bayland Recruitment will endeavour to supply Workers who are suitable for the Client's requirements. However, Bayland Recruitment does not guarantee the suitability of any Worker and shall not be liable for any loss or damage arising from a Worker's actions or performance during an assignment.
Bayland Recruitment collects, stores, and uses personal information in accordance with the Privacy Act 2020. Information provided by Workers and Clients will be used solely for the purposes of providing recruitment and employment services. Workers have the right to access and correct their personal information held by Bayland Recruitment.
These terms and conditions are governed by the laws of New Zealand. Any disputes arising shall be subject to the exclusive jurisdiction of the New Zealand courts.
Bayland Recruitment reserves the right to update these terms and conditions from time to time. Workers and Clients will be notified of any material changes.
